Recent heavy vehicle compliance activity has again put fatigue management near the top of the risk agenda for Australian transport operators.
While enforcement is usually framed as a road safety issue, it also has a direct insurance dimension.
Insurers assessing truck insurance risk increasingly look beyond the vehicle itself and ask how well the business controls driver behaviour, scheduling pressure, maintenance downtime and record-keeping.

For owner drivers and fleet operators, fatigue is not simply about whether a driver feels tired on a particular day. It is about the systems behind the journey: roster design, delivery windows, rest breaks, work diary accuracy, telematics alerts, subcontractor oversight and whether management acts when warning signs appear. A serious incident involving fatigue allegations can make a claim more complex, particularly if records are incomplete or inconsistent.

This matters because transport insurance has become more evidence-driven. A well-presented operator can often demonstrate that risks are being actively managed, even after an incident. A poorly documented operator may struggle to show that its procedures were followed, that drivers were properly supervised, or that scheduling did not create unreasonable pressure. That gap can influence claim investigations, renewal discussions and the conditions attached to future cover.

The issue also connects with broader reform. As discussed in our earlier coverage of the new Heavy Vehicle National Law, safety systems are becoming more central to how responsibility is assessed across the transport chain. Fatigue controls are likely to sit firmly within that trend, especially where multiple parties influence when, where and how freight is moved.

Practical steps for operators include:

  • Reviewing rosters and delivery commitments against legal work and rest requirements.
  • Keeping driver records, maintenance logs and incident reports accurate and easy to retrieve.
  • Training dispatchers and managers to recognise fatigue risks, not just drivers.
  • Checking whether subcontractors meet the same fatigue and safety standards as employed drivers.
  • Reviewing the policy schedule and PDS so obligations, exclusions and notification requirements are understood before a claim occurs.

The insurance lesson is clear: fatigue management is no longer just a compliance file to keep in the office. It is part of the evidence that can help show an insurer your operation is disciplined, safety-conscious and commercially sustainable. In a market where premiums remain sensitive to claims costs and driver risk, that evidence may become increasingly valuable at renewal time.
