What Renewed ESL Reform Debate Means for Fitness Operators?w=400

Pressure for reform of NSW’s Emergency Services Levy is moving from an abstract insurance-sector issue to a practical cost question for fitness businesses.
Recent industry coverage has again highlighted how levies and taxes added to insurance premiums can compound the affordability challenge for small operators, particularly when weather losses and rebuilding costs are already keeping commercial premiums elevated.

This is an extension of our earlier coverage of the NSW parliamentary review into the levy. The key issue is simple: when emergency services funding is collected through insurance policies, the cost is concentrated on people and businesses that insure. For gyms, studios, mobile trainers and allied fitness providers, that can affect decisions about public liability, property, equipment, business interruption and other essential cover.

For fitness professionals, the risk is not only that premiums rise. The greater danger is that a business responds by reducing limits, dropping optional sections, or delaying renewal without understanding the consequences. A boutique studio with reformer beds, weights, mirrors, flooring, audio systems and client amenities may have a larger replacement-cost exposure than the owner realises. A mobile trainer may have less premises exposure, but still need protection for client injury claims, portable equipment, contractual requirements and income disruption after an insured event.

The ESL debate also sits alongside a broader insurance affordability problem. Severe weather, materials inflation, labour shortages and higher claims costs can all flow through to premiums. Removing or redesigning a levy may help, but it would not remove the need for fitness businesses to present themselves as well-managed risks. Insurers still look closely at maintenance, incident records, induction processes, professional qualifications, waiver procedures and whether activities match the policy wording.

Before the next renewal, fitness operators should separate three questions. First, what part of the bill is premium, and what part is tax, duty or levy? Second, are the sums insured still realistic for today’s replacement costs? Third, are liability and professional indemnity limits aligned with contracts, landlords, councils and the scale of client exposure?

If affordability is becoming a concern, the answer should not be guesswork. Use renewal time to review assets, revenue, locations and activities, then estimate appropriate sums insured before comparing options. A cheaper policy can be valuable if it suits the risk, but an underinsured one can create a far more expensive problem when a claim occurs.

For now, NSW fitness businesses should watch the reform process closely. Any change to the ESL could influence renewal pricing, but the fundamentals remain unchanged: understand your exposures, keep risk controls documented, and make cover decisions based on the real cost of recovering from a loss.
