A new Australian Financial Complaints Authority decision has put income protection claims under the spotlight, with useful lessons for tradies who rely on their own capacity to work.
The dispute involved a delivery driver who had received weekly income protection benefits after a serious arm-related medical condition prevented him from working.
The insurer later tried to recover more than $31,000 in paid benefits, arguing it had information suggesting he could have returned to work earlier.

AFCA found the insurer had not clearly established a proper basis to deny, limit or claw back the benefits. It also noted there were significant gaps in the evidence relied on to justify recovery. The worker was not required to repay the money, and the insurer was ordered to pay $1,000 compensation after debt collectors became involved. While the facts are specific to that case, the message is broader: recovering benefits already paid is a serious step, and insurers need strong grounds before taking that path.

For Australian tradies, the ruling is a reminder that income protection is not just paperwork sitting beside public liability, tools of trade insurance or commercial motor cover. If you are a sole trader, subcontractor or small trade business owner, an illness or injury can quickly affect cash flow, job scheduling and family income. A policy can provide vital breathing room, but only if the cover, definitions and claim requirements match how you actually work.

The practical takeaway is to keep your claim trail clean. Medical certificates, specialist reports, return-to-work restrictions, cancelled appointments and communications with your insurer should all be stored carefully. If your medical advice changes, or if you attempt modified duties, make sure the information is passed on accurately. Gaps or contradictions can create delays, disputes or pressure at exactly the time your business needs certainty.

  • Review waiting periods, benefit periods and monthly benefit limits before you need to claim.
  • Check how your policy treats partial capacity, modified duties and ongoing medical care.
  • Keep copies of all insurer correspondence, medical certificates and work capacity updates.
  • Ask for clarification before agreeing that benefits were overpaid or should be repaid.

This decision is also a timely prompt to review cover before renewal. A carpenter, electrician, plumber or mobile mechanic may have very different income risks from a delivery worker, but the discipline is the same: understand the policy, document the claim and seek professional assistance if the wording or claims process is unclear. For many trade businesses, the best insurance outcome starts well before a claim is lodged.
