Why Defect Claims Are Re-emerging as a PI Pressure Point

Soft insurance conditions do not remove the need to test policy fit, documentation and contract risk

Why Defect Claims Are Re-emerging as a PI Pressure Point?w=400

Fresh specialty insurance market commentary has put construction-related professional indemnity risk back in focus, with Hall & Wilcox warning that latent defects, insolvency-driven disputes and broader liability settings are likely to keep claims activity elevated over the next 12 to 18 months.
For Australian professionals involved in design, engineering, certification, project management, supervision or technical advice, the message is clear: a softer insurance market does not necessarily mean a softer risk environment.

The warning matters because construction disputes often emerge long after the original work is completed. A design assumption, certification decision, site instruction or review process may only be tested once water ingress, cladding concerns, structural issues or remedial costs appear. If a builder, developer or subcontractor has become insolvent by then, claimants may look more closely at solvent consultants, certifiers and other insured professionals in the project chain.

That timing can be difficult for claims-made professional indemnity policies, where notification, retroactive dates, continuous cover and run-off arrangements can all affect how a later allegation is handled. It also reinforces why construction professionals should not treat renewal as a simple price exercise. A cheaper premium may still leave unresolved questions about design-and-construct exposure, contractual liabilities, subcontracted work, territorial limits, aggregation, defence costs and whether the policy wording reflects the work actually being performed.

The development also sits against a wider commercial insurance backdrop. Recent market updates have pointed to strong insurer competition and continuing rate pressure in parts of professional indemnity and financial lines. That can be useful for firms seeking to improve terms or reassess limits, but it can also create a false sense of comfort if claims inflation, legal costs and defect disputes are developing more slowly than premium cycles. Construction risk is especially sensitive to documentation quality, clear scopes of work and the evidence trail behind professional judgement.

Practical considerations for construction-sector professionals include:

  • checking whether contracts impose insurance limits, hold-harmless clauses or liability assumptions beyond normal professional duties;
  • keeping complete records of advice, design changes, client instructions, site observations and sign-offs;
  • reviewing professional indemnity policy exclusions for insolvency, assumed liability, rectification, cladding, pollution or product-related wording;
  • notifying insurers promptly where a defect, complaint or demand may become a claim; and
  • considering how run-off cover may apply after retirement, restructuring, project completion or a change in business activity.

The outlook is not a prediction that every construction professional will face a claim, nor that every policy will respond in the same way. It is, however, a timely reminder that professional indemnity insurance should be aligned with real project exposure, not just market pricing at renewal.
